Who these terms are between

These terms govern your use of this website and the quoting process it offers. They are between you and Apex Path Logistiks.

Using the site means you accept these terms. If you do not accept them, do not use the site.

Quotes are estimates until they are agreed

A quote produced through this website is an estimate based on the information you give us. It is not an offer capable of acceptance and it does not create a contract to carry anything.

Binding rates, service levels, liability limits and insurance are set out in the service agreement your account manager sends after the quote. Where a quote and a signed service agreement disagree, the service agreement governs.

Written rates we quote are held for 90 days from the date of the quote unless the quote says otherwise.

Carriage, service levels and claims

Delivery windows, proof of delivery, liability limits, claims handling and insurance are defined in your signed service agreement.

The refund and claims policy explains how to raise a claim and what remedies are available.

Carriage within Ontario is subject to the Highway Traffic Act and the regulations made under it, including the minimum uniform conditions of carriage. Nothing in these terms reduces a right those regulations give you.

Tracking

The tracking panel on the home page is a demonstration. It returns the same sample timeline for any number, because no live shipment data is wired to this site yet. Do not rely on it to locate a real shipment; use the tracking details in your confirmation email or ask your account contact.

Using the site

Do not submit information through the forms that is not yours to submit. If you fill in a driver application, it has to be about you.

Do not attempt to interfere with the operation of the site, to gain access to the staff area, to probe or scan it, or to submit automated traffic to the forms. Submissions are rate-limited, and we may block traffic that abuses them.

Do not copy, scrape or republish the content of this site beyond what the law allows.

Accuracy of what you tell us

You are responsible for the accuracy of the information you submit. A quote priced from inaccurate volumes, weights or locations may be re-priced once the real figures are known, and we will tell you before that happens.

Intellectual property

The design, text, code, photography and artwork of this site belong to Apex Path Logistiks unless marked otherwise.

Client names and logos shown on this site are the trademarks of their respective owners and appear with their permission. Nothing on this site grants you any right to use them.

Availability

We try to keep the site available, but we do not promise it will be uninterrupted or error-free, and we may change or withdraw any part of it.

Liability

Nothing in these terms excludes liability that cannot be excluded by law, including liability for fraud, for personal injury or death caused by negligence, and any statutory rights you have as a consumer under the Consumer Protection Act, 2023 (Ontario).

Subject to that, our liability arising from your use of this website is limited to the amount you have paid us, if anything, for the service the claim relates to. Liability for carriage is dealt with in the service agreement, not here.

Governing law

These terms are governed by the laws of the Province of Ontario and the laws of Canada that apply there. The courts of Ontario have jurisdiction, and nothing here prevents you from bringing a claim in the Small Claims Court or from using any dispute-resolution route the law gives you.

Changes and contact

We may update these terms. The date at the top of this page shows when the current version took effect, and using the site after that date means accepting it.
